GARDEN CITY, Kansas -- Garden City fire investigators have released the names of three killed in a fire early Sunday morning.

The fire broke out at a apartment in 4000 block of East Nancy.

Fire investigators say 26-year-old Nichole Savoy and her two children, 6-year-old Bryn and 22-month-old Madelyn, were found inside the bedrooms of the home.

Firefighters removed the two children and Finney County EMS transported them to St. Catherines Hospital were they were pronounced deceased.

"She love life. She loved those babies that's for sure. Other than that, she was a really good person," said Taren Mullet, neighbor.

Questions remain whether or not the apartment had a working smoke detector.

Neighbors in the complex say the apartments don't have smoke detectors which violates a state law.

The landlord tells KSN he didn't know that law existed.

Meanwhile, the Finney County Sheriff's Office, Garden City Fire Department, and Kansas State Fire Marshal's Office are trying to determine the cause of the fire.

I used to live in that exact appt. when my son was born and that was 6 years ago even then the smoke dectector didnt work. Just another thing burgess was "gonna get around to" but apparently never did. Steve Burges is a foul man he once stood at my front door and called me a P.O.S while i was holding my newborn daughter, because quote i should be the one working and not my wife. He is if not the complete definition of a slum lord. It took him almost 6 months to remove a couch that had a dead cat in it. i had to threaten him with refusing to pay rent, that sure got him out there fast. oh and one more thing im positive he charged me with replacing the battery for the smoke dectector in both rentals. i cant express how much i love paying for things that dont exsist. If anything the state of kansas needs to revoke his right to lease anything due to his obvious senile age. i hope he is left with the same he left those children and thier mother and that is nothing.

This man is guilty of murder. "malice aforethought" is the knowledge that one's actions are likely to result in death. The "rule of felony murder" is a legal doctrine in some common law jurisdictions that broadens the crime of murder in two ways. First, when an offender kills accidentally or without specific intent to kill in the course of an applicable felony, what might have been manslaughter is escalated to murder. Second, it makes any participant in such a felony criminally liable for any deaths that occur during or in furtherance of that felony.

Yes, this is a sad tragedy, Nichole and her girls will be greatly missed. To the person who called in the fire, thank-you, you did what you could. They were a lovely family that I had the privelage of knowing for the last 6 years. I feel that at least they are together wherever they go, that helps me a little. To the landlord, I truly hope you were ignorant of the law of fire alarms, if not, I am sure your mind will be punishment enough for you. I would hope out of this everyone makes sure they have working smoke detectors, PLEASE everyone make this mean something, check your detectors, and make sure all your loved ones have them!!!!!!! We love you Nichole, Madelyn, and Miss Bryn!!!!!!

Negligence of the law is NO defense! It is ALL the landlords responsibilty to make sure he knows the law! Three beautiful souls were taken all due to one mans stupidty and he should be held accountable for it ALL! I see at minimum 3 wrongful deaths suits coming Steve Burgess's way very soon! My thoughts and prayers are with the family!

I hope this landlord is prosecuted! He is a slum lord and cares only about money. All other landlords should note, the statute not only says every rental unit shall have a smoke detector, but it shall also BE MAINTAINED.

are you serious.....this landlord is so freaking stupid that he "didn't know" that all home should have a smoke detector.......I am so mad right now...I can't believe this...Nicole was such a wonderful woman and everytime I ever saw her she was talking about those precious girls!!! I am deeply saddened by this and I will be praying for the family....and as for the landlord......I have nothing good to say so I will just end this here.... Nicole....you will be missed!
