Argument between neighbors leads to gun fire and debate

ARLINGTON, Kansas (KSN) – Several shots were fired at his truck after Ray Hawn went to visit to his neighbor out in the country outside Arlington.  The windows were blasted out.  All four tires were blown.  Bullet holes could be found near the gas tank as well as the headrest of the truck.

But after prosecutors with the Reno County District Attorney’s office reviewed the case, the homeowner wasn’t charged.

Ray Hawn was.  He’s now facing as many as seven months behind bars for trespassing and disorderly conduct.

“I’ve been waiting patiently for the system, the law to work, and it doesn’t look like its working very well,” said Hawn.

Hawn drove to the house in Arlington to confront his neighbor on Oct. 7.  He says he was upset at the neighbor over allegedly harassing a friend. 

“I pulled in the driveway, I was yelled at, and I realized he was going for his rifle and I started to leave,” Hawn said.  “I told him to go to hell or something.  Like I said, the guy’s got a short fuse and anything can trigger him.”

The neighbor doesn’t mince words when talking about his dealings with Hawn.

“Raymond Hawn is a liar,” the homeowner tells KSN in a statement.  KSN is not identifying the homeowner because he hasn’t been charged with any crimes.

The homeowner claims Hawn has been warned repeatedly to stay off the property by himself as well as sheriff’s deputies.

“Mr. Hawn is a danger to our family and property,” the homeowner says.  “He should not be believed.”

Kansas law allows homeowners to use force when protecting their property if the homeowner reasonably believes it’s necessary to prevent someone from entering their home.

Prosecutors refuse to public ally comment about the details of the case but stand by their decision to charge Hawn and not the homeowner.

“We don’t try cases on TV or in the newspaper,” said Reno County District Attorney Keith Schroeder.  “We have to try them in the courtroom and that’s where the truth is going to have to come out.”

At Hawn’s preliminary hearing on Tuesday, prosecutors told the judge they plan to seek jail time for Hawn.  He has another court hearing scheduled later this month in Hutchinson to make sure he has a lawyer before the case goes to trial.

I live in the area that this incident occured. We have a lease on a lake near Hawn's property. Mr. Hawn and his friends seem to think the lake is there to use at free will. His trespassing of this lake has been happening sence last spring with no reguards of not only tresspassing but removing the "stocked" fish that we have paid for. Other lease holders have made the same complaint. The lake has been posted for years which Mr. Hawn and his friends and relatives seem to ignore completely and make themselves at home even after being asked to stay off the property. Mr. Hawn is waiting for the system to work and if he wakes up he will find it is and working very well in this case. Thank God for the Reno County Law Invorcement

I don't know who you are "aggregate", but you could not have been more accurate & on target. If the "system" worked, Hawn would have been issued a DUI immediately. The main issue here is: why was he there in the 1st place? And as to what was said, well it was definately more than "go to hell"....I don't know all the facts...but I know far more than I wish I did. "a danger to himself" is sad, but too true.

1st comment might be more correct than the writer knows. I believe Mr. Hawns view of the insident could be a bit hazy due to the fact being under the influence of foreign substances leaves the memory a bit lacking. His condition makes a person wonder why he was even attempting to operate a vehicle let alone "confornt" a neighbor. Perhaps Mr. Hawn nor his friend understand the words "no tresspassing". There are just some people that have no respect or reguard for their neighbor or the law.

I am betting there is much more to this story than just what the "victim" is saying. Sounds like he went whining to the press when things did not go his way. He went looking for trouble - and found it...
