Judge dismisses two lawsuits in coal plant fight

TOPEKA, Kansas , July 15, 2008 – The legal saga continues as Sunflower fights for a controversial coal-fired power plant in Holcomb. Now a

County judge has thrown out a lawsuit challenging the state’s denial of the plant.

 

 

 

 

But it’s not exactly bad news for Sunflower Electric as it is exactly what the company expected to happen.

 

 

 

 

The goal is to get this case to the Kansas Supreme Court where Sunflower hopes to overturn the state’s denial of the air quality permit. That’s what held up the huge project in the first place.

 

 

 

 

Supporters say the plant is key to the economy of western

Kansas , but the state’s top health official denied the permit, calling it bad for the environment.

 

 

 

 

An appeals board will hear Sunflower and then send its finding back to Judge Bremby. He will make his second decision on this and what he decides there will likely send this case back to court.
