Could changes already be coming to new state smoking ban?

TOPEKA, Kansas – The state’s new smoking ban will go into effect July 1st. Many business owners across Kansas are upset and are asking for changes. And some in Topeka are listening.

The Kansas Restaurant and Hospitality Association, among others, has complained about the new ban and a House panel is also considering changes to the law – even though it doesn’t go into effect until this summer.


The bill would change the effective date to January 1st and would reduce the outside smoking distance from doorways from 10 feet to three feet.

Some say smoking should be allowed in certain clubs, like the Players Bar and Grill in Wichita, which built a special smoking room to comply with the local ordinance. That smoking room would be illegal in July.

'”There need to be some kind of regulation on smoking,” said Dave Chaffin, owner of Players Sports Bar. “I'm not saying just because I built a smoking room I should be forever exempt or anybody else, but enough for else to recoup our losses is a smart way to do it.”

As expected, those who pushed for the statewide smoking ban see things differently.


“The new state law is a uniform law,” said Diane Tinker with the American Lung Association. “It's gonna give a level playing field to everybody across the state of Kansas. One business or one bar isn't going to have a perceived benefit or positive thing that another bar or restaurant doesn't have.”

It’s not clear that the bill with the proposed changes will even make it out of committee. The committee chairman did not say if a committee vote would even be taken.

I think every city, town and county that doesn't want to participate should bail out and not allow the state to interfere. States are bailing out of the Health Care plan, so do the same. As a Mayor or City Manager, refuse to let your town be dictated to. One other question, how much of our tax dollars are going to be spent on the smoking police? I also find it ironic to try to raise the cost of cigarettes by a dollar a pack and then not let us smoke anywhere. They want smokers to fund the state deficit, but they don't want us to smoke.

hey Non smokers dont push your ideas and rights on us we wont tell you where you can live or what car you can drive. Its your right just not to come in my bussiness if I allow smoking just like it is my right not to go in any other bussiness for any reason!!!!!

Every body will be on level playing field I think NOT. You need to read the ban again. Every body except PRIVATE CLUBS licensed before 2009 thats not right either you can be private and allow smoking or you cant. Or you need to grand father all smoking establishments. which in wichita is minimal. Oh yeah lets not forget the MONOPOLY the state is running. Exempt "STATE OWNED CASINOS" Then if they are exemot then any place that has the STATE OWNED LOTTERY they should have the option if. Either make every thing fair or ban it every where.

I think they can come to a compromise where there is "clean air" for the nonsmokers without taking away the smokers' rights to "murder" themselves... "NotAHick" - Five years in prison, really? I can see your point if a smoker is blowing the smoke into a baby's face or something crazy but in most cases where this new law will apply will be in bars and whatnot where there is only an adult crowd - the smoking crowd is pretty much seperated in most places I've seen anyway.. so as long as the nonsmokers have the capability of choosing where their location (don't hang out in a smokers room if you don't like smoke) then "murder" is a pretty strong word.

If you want to change the law, then change it in favor of NON-smokers! Not smokers! There should be an amendment to this bill that includes casinos! Clearly it is the right of the air-breathers to breathe clean air over the rights of the smokers to murderer by second-hand smoke! Let's take it one step farther and make it a crime punishable by 5 years in prison for attempted murder!!!

The American Lung Association gets millions from the makers of Chantix to to push smoking bans from it's "smokless states program". It's simply marketing strategy with lots of "sky is falling" hype. http://www.rwjf.org/pr/product.jsp?ia=143&id=14912
