Fmr. Wichita teacher plans to fight sex-related law

WICHITA, Kansas – A teacher convicted of having sex with a student will try to get the law tossed out, saying the student was an adult and the sex shouldn’t be criminal. The teacher is 30 years old. The student was 18. And a state law makes sex between the two a felony. But the teacher’s lawyer says the law is unconstitutional and will fight to get it erased from the law books.

Attorneys for 30-year-old Charles Edwards are not fighting his firing from the Wichita School District. But they say his arrest on criminal charges is unconstitutional. Edwards taught vocal lessons at Northwest High School and had sex with an 18-year-old student.


Kansas law bans any sex between any kind of law enforcement officer and inmates. There’s also a clause saying it’s criminal if the offender is a teacher or a person in position of authority and the person with whom the offender is engaging in consensual sexual intercourse is a student enrolled at the school where the offender is employed.

Edwards’ attorney says his client pleaded guilty to the charge so they could begin appealing the law.

“How far do we want the state to pry into our individual consensual sexual relationships?” said legal analyst Dan Monnat, who is not representing Edwards.

Monnat says Edwards may have a case against the constitutionality of the law.

A Supreme Court ruling declaring laws banning gay sex between consenting adults may apply to this case. Monnat says just because people may find a relationship inappropriate, doesn’t mean it should be against the law.

“There may be all kinds of consensual sexual relations that the public finds in bad taste, but does the public want to send those persons to prison?” he said.

Edwards will be sentenced on the conviction in May. His lawyer is expecting probation because of his client’s clean criminal record. The appeals process is expected to take about a year

If this law is struck down, it's not just our 18 year-olds in high school we'd have to worry about. The age of consent in Kansas is *16.* As someone who had a daughter go through Wichita Public Schools, I find the notion that teachers could coerce their students, some as young as sophomores, into sexual relationships, horrifying and appalling. I'm stunned that any lawyer thinks this law should be challenged, and I hope a) the challenge fails, and b), that the judge imposes the maximum sentence on this offender.

So Nate, killing is immoral and should be outlawed. Yet, in a fit of retaliation we drop a bomb on two Japanese cities and call it redemption. As reprehensible as it is, killing has been going on for centuries in the name of kings and dynasties and not one civilized society has successfully put a stop to it yet. The Bible says "an eye for an eye.." so who are we as upstanding christian in our modern industrial world to say what is morally right or wrong? It simply boils down to what a socioculture tolerates at the time, and it changes from one to the other...as history has shown.

I will chim in on this! There is a big difference between inmates and students!One is locked up and there other has free will to come and go as they wish! Plus she was 18 legal adult! If they dont want this to happen maybe they should raise the legal age!!! Other wise 18 is 18 and if your not confined then you have the ability to leave or not have sex. If your married or have girl friend who inrolls in your school where you teach then by this law you must get a seperation or not have sex!! This Law needs to be trashed its a joke!!!

Ya really when is enough gonna be enough? How about Kansas stop making up as many rediculous laws as they can think of in order to put as many people in jail as possible, 5 seconds later they will realise O WAIT, WE RAN OUT OF ROOM FOR OUR PRISONERS YEARS AGO!! We better let another murderer out early so we can put this guy in jail for doing something legal hahahahahaha. He'll learn his lesson!! Why are there so many hicks in Kansas? lol really where the hell did they all come from and did they all grow up in caves? "Moral" people don't have sex at all, they think it is dirty unless it's with an alter boy. So why haven't all of these "moral" people died off yet? When the hell are they all gonna be gone so everyone can actually live and have a life without someone bltching about somebody elses business. I bet a lot of money you are all just a bunch of losers without jobs mad cause you wish you could get a young lady to even look at you lol.******************************************************************** Nate lol, when you put imporal I actually just thought you were combining important and moral lol.

When is enough, enough? The laws in KS were designed to protect the student who in fact is just that, a student! This 18-year old may be considered an adult by the law, but it hardly what I would consider an adult in maturity. If there is any doubt, honestly ask yourself, have you met an 18-year old lately? This man was put into a position of authority over this student and used that to his advantage. A case in 2008/2009 in Franklin Co. KS nearly went the same course with trying to appeal the law, and that teacher only received probation in his case too! Perhaps if the penalty were stiffer for such violations, they wouldn't be occurring with such fequency. Bottom line, this man is a predator, and will continue to prey on younger victims in the name of "love," as long as he's allowed to get away with it.

What has happened to the upstanding citizens of America. It doesn't matter if she was 16 or 18. I don't care if she was running down the hallway naked. This grown man was in a position of trust and supposed to be a role model for this student and all students and he took advantage of that. I say if he can't control his urges enough to follow school policy and just plain civilized behavior then let him go. He's doing more harm then good. Just because it's legal doesn't make it right.

Actually you CAN legislate morals, most of our laws are based on the MORAL of what is right and what is wrong. Murder and rapefor instance are only illegal because our society says it is imporal to rape and kill.

You can't legislate morals. In attempting to force your own morals on another person you are being immoral yourself. It isn't against the law for 2 adults to have sex. If there are rules for being a teacher and you break them that doesn't mean you go to jail or even committed a crime. That is rediculous. Then if you come in late do you get probation? Since you know you are not suppose to come in late I guess you are now immoral and should go to jail. Get plenty of sleep everyone, don't wanna be late to your jobs tomorrow (if you have one). Plenty more rights to trample still.

There is no way to justify this behavior. This was unethical and unprofessional on the teacher's part. Having outside relationships with clients or students in inappopriate and the law is in effect for these reasons.
