Judge won't dismiss grandparent's lawsuit

WICHITA, Kan. (AP) - A federal judge has refused to dismiss a lawsuit filed by grandparents accusing a social worker of failing to protect a toddler who was beaten to death by her father's girlfriend.

U.S. District Judge Monti Belot ruled Friday that maternal grandparents Larry and Mary Crosetto had enough facts to overcome the state's claim of qualified immunity for social worker Linda Gillen.

The Kansas Department of Social and Rehabilitation Services argued that Gillen had "no duty to intervene" after she investigated a report claiming abuse and neglect of the 23-month-old Coffeyville girl, who died in 2008 as a result of head injuries.

The Crosettos sued Gillen in January, accusing her of gross negligence for not protecting their granddaughter despite repeated complaints alleging abuse. The suit does not name the agency as a defendant.

mountianllama be careful what attorney you get. The ones I have dealt with are corrupt to. Also Judge Dan Brooks go along with Youthville. We need to form a group against Youthville ,SRS, attorneys and jugdes that are corrupt in Wichita,ks. I know you and I are not the only people that have had trouble with these agencies.

I do know a foster parent that works with youthville,she has no income but what she receives for the kids she takes in. The house they live in should be condemed. One of the children she adopted thru youthville. The little boys family wanted him,but like I have heard, and my own personal experience with youthville and srs,I am sure the family was bullied and threated by the workers,just as my family was.How can someone adopt a child without having and income.Also I have witnessed the foster parent slapping the little boy around. Youthville needs to be investigated. I am one grandparent that is going to keep fighting. And I would like my story in the news and newspaaper, we as the people cannot let youthville, Srs and attorneys in Wichita,Ks get away with their criminals. Kansas has lost to many children.

I am gald the judge will not dismiss lawsuit. SRS in Wichita,Ks is not doing their job. MY family and I filed a private CINC if care case on my two grandchildren. SRS did not investigate. They spoke with the parents for 2 hrs. and I guess they know them better then the family and neighbors that have witnessed my two grandchildren being abused. All three parents or on drug and are abusive. Two more children SRS let slip thru the cracks. My family and I were trying two keep my grandchildren safe, we were bullied, threated by SRS,Youthville and local attorneys and I have all the evidence to my statement. The state needs to be held accountable.

So sad that with our system, the child at need seems to be the last thing these folks are worried about. And we wonder why the crime rate is up, kids dropping out of high school is up and sending our kids to public schools is a gamble on their safety.

I have been dealing with Youthville trying to adopt a family member. I can tell you that at-least the part they play in the CPS system is EXTREMELY CORRUPT. They are not bound by ethics, or court orders. They do as they please, break any rules they want. And then hammer you any chance they can, for any silly thing they can. And that is what they do to the family member wanting to adopt the kid in need. Could you imagine being a parent having to deal with these criminals? Having a private company adopt out children taken by the state is a rotten idea. The state gives them alot of money if they have to adopt the child out of the family. They give them nothing to adopt within the childs family. Youthville is a private company. They need to make money. So with no incentive to place a child with their family, they try to find a reason to place each child out of family. This system is very very corrupt. We need an organization willing to fight this corrupt system. We need some honest Judges to stand up and change things. What they have done with the family member I am trying to adopt is nothing short of mental torture. And is deserving of a great big lawsuit. If there is a lawyer and want that case let me know. You can keep 80% I would make it 100% but Youthville has made sure I had maximum expenses. you just have to be willing to challenge the system, and be willing to insist that changes be made to their system so that maybe other children wont have to be tortured so badly. The childs Therapist has even made statements of how worried she has gotten about the child's well-being. She was never worried about the child's mental well-being before Youthville got involved. And of course you have to win.

The agency certainly should be named in the suit. Gillen's behavior is merely the typical malfeasant Culture of the Agency.
