Personhood Amendment aims to outlaw abortion

TOPEKA, Kansas -- Where does life begin? It's a question the Kansas legislature has tackled before, but the question is taking a new route in the abortion debate.

"Conception happens and it’s a unique and individual human being,” said Rep. Jim Howell, a sponsor of the proposal.

The personhood amendment would change the language in the state constitution “to guarantee rights, and protection to humans from the beginning of biological development, including fertilization.”

“It's time to address the issues and recognize that we no longer see it as a blob of tissue,” said Margaret Mans with Right To Life for Kansas.  “It is a unique human being with its own DNA."

The amendment is stirring strong opposition from both sides of the abortion debate.  They argue the language is too broad and would create a legal frenzy.

“The anti-choice is divided, I don't know how they expect the majority of Kansas to get behind it,” said Kari Ann Rinker, State Coordinator for Kansas NOW.

Because it would be a constitutional amendment, there would have to be an explainer on the ballot.  For those in opposition, that language is just as bad as what's being proposed.

As it's written, the current federal legal status of preborn humans “would remain that of a class of human being that can intentionally be killed.”

“It basically says if you do not vote for this you are condoning murder,” said Rinker.

Supporters argue the main goal here is to challenge Roe v.Wade.  That’s an uphill battle for supporters.

"If our legislature adopts this constitutional amendment it is doomed to failure,” said attorney Dan Monnat.

Monnat says the language is too vague to be upheld in court.

“Does it mean from the formation of the egg? Does it mean from the formation of the sperm?  Does it mean from the second the sperm meets the egg?” Monnat questioned.

cynsconcern, if you really think the lack of readily available abortions will make people more careful resulting in fewer pregnancies, it isn't "the people" who are stupid.

It's not health care it's a form of birth control because people are too stupid to take pills or other precaustions. The doctors who perform these are not there for anyone's health, but for the money......it's all about the money. If abourtion wasn't so readily available.....people would be more careful.

Kochs, brownback and the teaparty strongly defend individual freedom, but that freedom doesn’t include a woman’s right to decide her own healthcare needs. wake up women!

Howell clearly doesn't know what he's talking about since he doesn't know the difference between fertilization and conception. It's just more proof that politicians shouldn't be in charge of making medical decisions for people. His legislation will ban contraception, ban abortion, ban in vitro fertilization and will make miscarriages a criminal offense. In other words, it's an example of Republican small government.

The REAL issue is the man who causes the pregnancy is irresponsible in another example: say I had a very contagious disease spread by coughing and sneezing.....and you and I were close enough that when I sneezed I blew snot all over you. You get sick....is it your fault or mine? Same thing w/ sperm men are accountable for their own body fluids whether HIVSTDor viable sperm. The focus has been on the wrong gender since the beginning of mankind. If men can't be responsible for the offspring they produce they should get SNIPPED!!!! We aren't much further in mentality than the mid east who stone women for adultery....what about the man? Same thing. SNIPPING CLINICS would be much cheaper, as there wouldn't be a long line to have the procedure, a much more simple procedure, they could pay to store their sperm....then they can REALLY decide when to have children.

No politician in this country will ever be elected with a pro-choice opinion; and abortions will never, ever stop. I agree with 51gopher’s comments. When the people on the picket lines and the politicians take steps to do something for all the unwanted children, then maybe they can do some good.

If we turn the abortion market into an underground black market than the number of abortions will likely increase. The women will no longer get the pre-care and counseling, or the post-care and counseling that they get now. I honestly believe it is way better to have licensed and legitimate clinics performing the few abortions that take place now days. Than have an increase in the number of them, with an increase in risk and mental health issues from the mother. The closed minded anti abortion nutjobs need to try real hard and look at the entire picture.

I don't agree with abortion one bit. But at the same time I understand why people feel they are necessary sometimes. I think the energy and money spent on this abortion issue could be of better use and save more lives by being spent on the youth of this country and educating them, and simply caring for them. If we do our job right as parents and teachers abortion would become such a minor issue that we wouldnt even be having this conversation. I have never heard of or seen a story of an anti abortion protester who prevented an abortion by adopting a child. This abortion issue has cost too much money, and has robbed the political focus from more important issues. The fact is that if you make abortion against the law you will find dozens of black market type, underground clinics start performing them.
