WICHITA, Kansas -- Scott Roeder is charged with first degree murder in the death of Wichita Dr. George Tiller.
Roeder appeared before a judge in Sedgwick County District Court Tuesday afternoon.
Judge Ben Burgess said Roeder is charged with one count of murder in the first degree and two counts of aggravated assault.
Burgess said no bond will be permitted. The judge also said Roeder is not allowed to have any contact with witnesses or the Tiller family.
Dr. Tiller was a nationally known abortion provider who was shot to death Sunday morning while serving as an usher at Reformation Lutheran Church in Wichita.
Investigators say the two assault charges against Roeder are because he allegedly pointed a gun at two other people inside the church.
Because of financial paperwork Roeder submitted, Judge Burgess approved a court appointed attorney.
Roeder asked the judge who the attorney would be. The judge answered that it will be one of the attorneys available through the Public Defender's Office.
Roeder then asked how long it would be before he could meet with the attorney. The judge said that it could take 24 to 48 hours before the attorney contacts Roeder.
Roeder's next court appearance will be June 16, at 9 a.m.
After the court proceeding, District Attorney Nola Foulston held a news conference. She was asked if Roeder could get the death penalty. She said that, with the current information, this is not a capital murder case, and as such, does not qualify for the death penalty.
