Charges pending in accidental gun discharge at graduation event


EL DORADO, Kan. (KSNW) – A shooting at a high school graduation in May is leading to criminal charges stemming from the incident.

The Butler County Attorney Darrin Devinney is pursuing charges of aggravated battery and illegally discharging a firearm against Gary Atherton.

Investigators say Atherton had a gun concealed inside his sock at the Augusta High School graduation on May 15th when it went off while he was adjusting it.  The bullet fired from the .380 caliber handgun struck Atherton and a woman who was sitting nearby.  Both of them suffered minor injuries.

Atherton is due in court on June 8th.
