Affidavit details abuse, neglect in Wichita toddler’s death

WICHITA, Kan. (KSNW) – The probable cause affidavit into the death of a Wichita 2 year old has been released.

Zaiden Javonovich was found dead inside a crib in a south Wichita mobile home April 12.

Police were initially called to the home to investigate an argument between the toddler’s parents, Patrick Javonovich and Brandi Marchant. A neighbor had called police to reporting yelling and a door slamming. 

The document said Marchant did not indicate there were children in the home, but Javonovich later allowed officers to go in to check on the welfare of the children. 

Officers found a 4 month old “partially under a standard sized pillow up against the side of the crib.” A large number of pillows and stuffed animals were found in the infant bed. The officers continued checking the house and found Zaiden “inside a tightly wrapped and tan in color blanket in the form of a swaddle and was face down” and his arms were confined inside a set of zip-up pajamas. The arms of the pajamas were tied together. Marchant told police she swaddled Zaiden to prevent him from getting out of his crib.

An officer noted that Zaiden was “not moving and cold to the touch.” The officer said Zaiden was “black, blue, and purple and green in color” and had fluid around the bed and near the mouth “

The autopsy later reported that Zaiden was in early stages of decomposition. He had abrasions on the lips, nose and contusions to the head and trunk. The doctor said the injuries were “consistent with his face being forced down onto something by someone pushing on the back of Zaiden’s head.”

The 4-month-old boy was found in an infant bed “extremely malnourished and had a temperature of 94.9 degrees.” Doctors noted multiple bruises and a severe diaper rash and infection on the infant. The doctor “believes these injuries to be abusive in nature in addition to neglect.”

Patrick Javonovich allowed police to download his phone. Police said there was a text from Brandi on April 10 at 2:44 p.m. that said “I am losing it. I need to stay somewhere. Zaiden just won’t stop. I can’t even watch (expletive) tv.” It was followed by another text that said “He had 3 bags of oatmeal and 2 things of yogurt z [sic] and he is still screaming.”

Zaiden’s weight at autopsy was approximately 14.9  lbs and his length was 31 inches, far below the CDC clinical growth charts for a 25-month old boy.  

The 4-month old’s weight was approximately 8 pounds, which “does not even register on the graph” of the CDC clinical growth chart because “the chart only goes down to the lower five (5) percentile” according to the document. 

Patrick Javonovich and Brandi Marchant are charged with first degree murder, two counts of child abuse and child neglect.
