Affidavit shares shocking details behind 2-year-old Tony Bunn's death

WICHITA, Kan. (KSNW) - A probable cause affidavit shares new information about the death of a Wichita toddler.

Tony Bunn died earlier this month after being taken to the hospital not breathing.

His mother Elizabeth Woolheater, and her boyfriend Lucas Diel were charged with his death.

Woolheater and Diel are still behind bars following the morning of May 4th when Tony took his last breath.

Woolheater spoke to a detective who was on scene that day and in her affidavit she says Diel gave Tony hot dogs and then went to take a shower. 

She heard a bang and Diel got out of the shower to check on Tony. 

That's when Woolheater says "Lucas found Anthony face down on the bedroom floor." 

In Diel's affidavit, he shared a similar story.

But, in Woolheater's post Miranda interview, she had a different recollection of what happened. 

Woolheater says, when her and Diel were feeding Tony hot dogs, and he wouldn't swallow.

So she "'lost it' and hit Anthony on his cheek."

Then when she went to the bathroom, Woolheater "heard two smacks that she described sounding as though Anthony was getting a spank."

In the interview, Woolheater said she heard two or three more hits and then "Lucas yelled for help and sounded panicked." 

Woolheater says "Anthony's body was limp, pale, and he was not responsive."

In Diel's post Miranda interview, Diel denied any physical contact with Anthony on that date and said "he may have heard spanking sounds when Elizabeth was in the room with Anthony."

Medical reports describe Tony as being malnourished, with bruising on his head. 

The affidavit also shows that Diel and Woolheater originally called Diel's mother, who is a nurse, after finding Tony face down.

Diel's mother told them to call 911.

Tony died two days later.
