Man charged with attempted first-degree capital murder in attack of Wichita girl

WICHITA, Kan. (KSNW) – Corbin J. Breitenbach has been charged with attempted first-degree capital murder regarding the sexual assault of a 7-year-old girl in Wichita June 11. Breitenbach was also charged with aggravated criminal sodomy and aggravated burglary.

His bond has been set at $1 million and his next court appearance is scheduled for July 5.

Court documents allege that Breitenbach took the child from a bedroom, “strangled her to unconsciousness, and then took her to an outdoor balcony where he assaulted her.” The charging papers in this case do have a note that is uncommon to see in most court documents. It notes a “special allegation and notice of penalty.”

The documents say the state will argue that “the defendant’s conduct during the commission of the offense manifested excessive brutality to the victim in a manner not normally present in that offense.”

“With the allegation is that he strangled her unconscious, removed her to another room, there’s the kidnapping, intercourse, there’s the rape and it’s all taking place within the context of the intent to kill,” said Sedgwick County District Attorney Marc Bennett.

Bennett said Breitenbach and the victim’s family did not know each other.

Breitenbach was arrested at his place of employment last week. He was booked into jail on charges of attempted first-degree murder, aggravated burglary, aggravated sodomy, and rape of a child under the age of 13.

Breitenbach was released from jail on April 28 on prior convictions of aggravated sexual battery, intentional touching and aggravated battery – bodily harm with a deadly weapon.

The child is doing well and is with her family.
